Clean Air Rollback Takes Effect As Legal Challenges Move Forward

Fourteen states and a coalition of five environmental health organizations have launched legal challenges to the Bush administration’s overhaul of the Environmental Protection Agency’s New Source Review program, which relaxes limits on air pollution from factories, refineries, and power plants. The U.S. Court of Appeals for the D.C. Circuit recently denied a request by ten Northeastern states to stay the administration’s changes pending the outcome of litigation, which allowed the rule to take effect on March 3. California, Illinois, Delaware, and Wisconsin have also filed challenges to the rule.
