Incorporation by reference is a technique used by federal agencies to include, and make enforceable, material published elsewhere without republishing those materials in the agencies’ regulations. This technique is most often used to incorporate industry-developed code already widely in use. The director of the Federal Register must approve each incorporation by reference for it to be legally enforceable.
