In the Unified Agenda, agencies are required to include whether a given rulemaking action has "federalism implications." According to Executive Order 13132, federalism implications are those "that have substantial direct effect on the States, on the relationship between the national government and the States, or on the distribution of power and responsibilities among the various levels of government.'' This information is not required of independent regulatory agencies.
Federalism also refers to the legal relationship between the federal government and state governments and the legal and constitutional framework for those relationships.
